Terms and Conditions

By purchasing products or services from L&M Landscape Materials, LLC (“L&M”), the customer agrees to the following terms and conditions:

1. Payment

Payment is due at the time of purchase unless the customer has an approved credit account with L&M. Customers are responsible for all applicable taxes, delivery charges, late fees, and other agreed-upon costs.

1. Product Inspection

Customers are responsible for inspecting all products at pickup or immediately upon delivery. Any concern regarding the product type, quantity, quality, or condition must be reported to L&M as soon as possible.

1. Natural Product Variations

Mulch, stone, gravel, soil, sand, pine straw, and other natural products may vary in color, size, texture, moisture content, and appearance. Photographs and samples are provided as general references and may not exactly represent the delivered product. These natural variations are not considered defects.

1. Measurements and Quantities

L&M may assist customers with estimating the amount of material needed; however, all estimates are approximate. The customer is responsible for confirming measurements and ordering the appropriate quantity. L&M is not responsible for shortages, excess material, or additional delivery charges resulting from inaccurate measurements or estimates.

1. Delivery

The customer must provide accurate delivery instructions and ensure that the delivery location is safe, accessible, and suitable for L&M’s vehicles and equipment. The driver has the final authority to determine whether a requested delivery area is safe.

If the customer requests delivery beyond the curb or paved surface, the customer accepts responsibility for damage to lawns, driveways, sidewalks, curbs, irrigation systems, septic systems, underground utilities, or other property. L&M is not responsible for damage resulting from unsafe conditions or customer-directed placement.

Additional charges may apply if a delivery cannot be completed because of restricted access, unsafe conditions, incorrect information, or the customer’s unavailability.

1. Returns and Refunds

Refund requests must be made within 30 days of the original purchase date and must include proof of purchase. No refunds will be issued after 30 days.

Products must be unused, undamaged, and in resalable condition to qualify for a refund. All returns are subject to inspection and approval by L&M.

Bulk or loose materials that have been loaded, picked up, delivered, dumped, mixed, spread, or otherwise used are nonreturnable and nonrefundable. Delivery fees, special orders, custom products, clearance items, and discounted final-sale items are also nonrefundable.

Approved refunds will be issued to the original payment method when possible.

1. Order Changes and Cancellations

Order changes or cancellations must be requested before the product is loaded or the delivery vehicle leaves L&M. Special orders and custom products cannot be canceled once ordered from the supplier. Cancellation or restocking fees may apply.

1. Customer Pickup

Customers picking up materials are responsible for ensuring that their vehicle or trailer can safely carry the purchased load. L&M may refuse to load any vehicle or trailer that appears unsafe, overloaded, or unsuitable. The customer is responsible for securing the load and complying with all applicable transportation laws.

1. Limitation of Responsibility

L&M is not responsible for delays or inability to fulfill an order due to weather, road conditions, equipment failure, supplier delays, product shortages, government restrictions, or other circumstances beyond its reasonable control.

1. Past-Due Accounts

Approved credit accounts are subject to L&M’s credit terms. Past-due accounts may be placed on hold, assessed applicable late fees, or returned to cash-only status. The customer is responsible for reasonable collection costs as permitted by law.

1. Applicable Law

These Terms and Conditions are governed by the laws of the State of Tennessee. Nothing in these terms limits any rights or remedies that cannot legally be waived.

1. Changes to These Terms

L&M reserves the right to update these Terms and Conditions at any time. The terms in effect on the date of purchase will apply to that transaction.
